Ordering

In accordance with the Licensing Act 1964, it is an offence for any person under 18 to buy or attempt to buy intoxicating drinks. By placing an order you are confirming that you are 18 or over. We reserve the right not to deliver if we are unsure of this.

We cannot guarantee the availability of all products. Whilst we make every effort to supply wines exactly as specified but reserve the right to supply wines of equal or superior value and/or quality in the event of an item being unavailable. If you would prefer not to receive substituted items please add a note to your order at checkout. Bottles, glasses and labels can and do vary. The images shown on our website may not be the same as current stock items. If the bottle, glass or label is important please check before ordering. Branded glasses may contain small blemishes such as air bubbles etc, these are the result of the manufacturing process and are not deemed to be faulty.

Should you wish to make an amendment to your order please contact us as soon as possible. We regret that we are unable to accept amendments if your order is packed and ready for despatch.

By placing an order, you consent to an Advance Payment Charge.

Pricing

All prices are quoted in pounds sterling and do not include UK VAT unless specified. We reserve the right to change prices without notice.

Whilst we try to ensure all pricing on the website is correct occasionally an error may occur and items may be incorrectly priced. If we discover a pricing error we will contact you and ask if you wish to continue with the order at the correct price or cancel. We will not be obliged to supply items are the incorrect price.

Law

All contracts are governed by English law and jurisdiction.

Force Majeure

The company will not be liable for failure to meet agreed obligations due to prevailing circumstances beyond its reasonable control.

Claims

Deliveries should be carefully inspected at the time of delivery. Any omissions or breakages should be noted on the delivery note before signing. Please notify us immediately of any breakages or wine shortages. We are unable to guarantee credit or replacements unless we are notified within 3 days of delivery of the order. Please be aware that multi-case orders can become separated. If you do not receive the balance of your order within 3 working days of the first delivery please contact us. Standard UK deliveries should always arrive within 3 working days of the date of order. So far as the law permits however the company shall not be liable for consequential loss or damage in any respect of an order not being delivered correctly or on time.

Ownership

All wines and spirits or other goods ordered remain the property of Hatton and Edwards and its associates until payment is received in full.

Crime Prevention

For the purposes of crime prevention, the detection of offences and/or the apprehension or prosecution of offenders, we may share any information that we collect with the Police or other public or private sector agencies or representative bodies in accordance with the relevant legislation.

Deliveries

If you are not home when our carrier attempts delivery (UK only), they will leave a card giving a contact number which you may use to re-arrange the delivery, however they will attempt a second time. We regret that once an order has been processed, we are unable to change any delivery information.

Please note that our delivery rates are exclusive of VAT, insurance and local duties or taxes. Deliveries outside of the UK may attract local customs duties and taxes. The courier will contact you to take payment before your parcel is released from customs. We strongly advise speaking to your local customs office to find out what duties and taxes are payable on parcels containing alcohol. It is important that you are contactable when your parcel arrives in customs, otherwise your parcel may be returned to us and you may be charged for a re-delivery.

Please note that Hatton and Edwards cannot be held responsible for the actions of foreign customs authorities. Also note that if you fail to pay taxes due on arrival (within the required timeframe) your parcel may be seized by customs and additional fees may become payable before the parcel is released. Any additional fees incurred in this way are your responsibility and will not be covered by Hatton and Edwards.

Hatton and Edwards cannot be held responsible for the temperature of the country we are shipping to and therefore any affect this may have on your order. If you are concerned about temperature during shipping, we recommend that you arrange shipment at the most temperate time for the region in which you live or make arrangements to collect the wine from us.

Cancellations and Refunds

If you are not satisfied with your purchase, please contact us immediately. In most instances we will be able to offer a refund or exchange. Refunds will be processed within 30 days of the goods being returned. Goods must be returned in the same condition as to when they were despatched. Please note that if goods returned are not deemed to be in a saleable condition a re-delivery fee will be charged and no refund will be offered.

We are unable to accept returns on any Condition Note items – these are always marked with an asterisk*. Please review our Condition Note page or contact us for more information.

We regret that we cannot offer refunds for opened bottles of wine or the remainder of a case.

Wines, their corks and fine spirits are subject to natural processes that, however well cared for, can affect the quality of the product – particularly the older products we offer. Whilst all effort is made to ensure that our products are of optimum quality, this nature of our products may mean that a small percentage of bottles are not. Hatton and Edwards cannot accept any liability for this.

Costs of delivery and/or collection will be deducted from the refund unless it is agreed the refund is caused by faults made by Hatton and Edwards, or our courier or any other representative of our company.

Limited Liability

Hatton & Edwards accepts no liability for their actions beyond those stipulated under relevant sections of the Sale of Goods Acts and Distance Selling Regulations. Whilst Hatton and Edwards will take every reasonable care to supply wines they believe to be drinkable and of good quality, it should be remembered that all wines and their corks are subject to natural processes which, however well cared for, can affect the quality of the wine. No liability will be accepted for any deterioration encountered in our wines prior to sale.
